1. Agreement
This agreement sets out the entire understanding between Dale Zimmermann Photography and the Client. It supersedes all prior discussions or agreements. Any amendments must be made in writing and signed by both parties to be valid.
2. Booking Fee & Reservation
A non-refundable booking fee of 15% is required at the time of booking to secure the agreed date. Once paid, Dale Zimmermann Photography will not accept other bookings for that date. The booking fee is deducted from the final balance.
3. Cancellation by the Client
If the Client cancels the wedding photography services, the booking fee and any payments made are non-refundable. Cancellations within three months of the wedding date require payment of 50% of the remaining balance. Cancellations within one month require payment of the full balance.
4. Government Restrictions & Force Majeure
If the wedding cannot proceed due to government restrictions, venue closure, or events beyond reasonable control, every effort will be made to reschedule to a mutually agreeable date, subject to availability. If rescheduling is not possible, no further payment will be due beyond sums already paid.
5. Final Payment
The remaining balance is due no later than four weeks before the wedding date, unless clause 4 applies.
6. Substitute Photographer
In rare circumstances where the photographer is unable to attend due to illness or emergency, a suitably qualified replacement may be appointed. If no replacement is available, liability is limited to a full refund of all payments received.
7. Limitation of Liability
All reasonable care is taken with the capture and storage of images. In the unlikely event of total loss, liability is limited to the return of payments received.
8. Artistic Style & Coverage
The Client understands that photography is a subjective art and grants full creative discretion regarding style, composition, and image selection. While specific requests are welcomed, they cannot be guaranteed.
9. Meals
For full-day coverage, the photographer and any assistants should be provided with a suitable meal. If this is not possible, time may be taken to obtain food off-site.
10. Copyright & Usage
Copyright of all images remains with Dale Zimmermann Photography in accordance with the Copyright, Designs and Patents Act 1988. The Client is granted a personal licence for printing and sharing images.
11. Marketing Use & Opt-Out
The photographer may use images for portfolio, website, social media, and promotional purposes. The Client may opt out of marketing usage by providing written notice prior to the wedding date.
12. Unedited Images
Raw or unedited images are not supplied.
13. Venue & Ceremony Restrictions
Coverage is subject to restrictions imposed by venues or officiants. The Client accepts any resulting technical limitations.
14. Exclusivity
Dale Zimmermann Photography shall be the only paid professional still photographer at the wedding.
15. Conduct
Abusive or aggressive behaviour toward the photographer or team may result in immediate suspension of coverage.
16. Severability
If any part of this agreement is found unenforceable, the remaining provisions remain valid.
17. Cooling-Off Period
The Client may cancel within 14 days of booking for a full refund, unless services have already been provided.
18. Complaints
Any concerns must be raised in writing within 28 days of image delivery.
19. Image Delivery & Storage
Final images are typically delivered within 8-12 weeks. Images are archived for a minimum of 24 months.
20. Third-Party Suppliers
Recommendations are provided without liability or financial incentive.
21. Wedding Albums & Additional Products
Wedding albums are not included within photography packages and are offered as an optional add-on after the wedding. As wedding albums are bespoke, handmade products individually commissioned for each couple, they are exempt from the standard returns provisions of the Consumer Rights Act 2015. Clients are advised to carefully review all design layouts, image selections, and cover proofs before providing approval.
Once album proofs have been approved, the album will be submitted for print.
Printing turnaround is typically 3–4 weeks and is outside of the photographer’s control.
Clients will have up to three months from the date proofs are supplied to request amendments. If no amendment requests are received within this period, the design will be considered approved and may be submitted for print without further notice.
Where an album has been paid for in advance, it is the Client’s responsibility to request the album design within 12 months of the final gallery being supplied. Failure to do so will result in forfeiture of the paid album and any associated products
22. Governing Law
This agreement is governed by the laws of England and Wales.
By paying the booking fee, the Client confirms they have read, understood, and agreed to these terms.
